A federal judge has ruled in favor of SpaceX, rejecting an environmental group’s request to halt the company’s rocket launches at its Boca Chica Beach facility in Texas. The lawsuit was filed by Save RGV, a Texas-based nonprofit, which argued that SpaceX’s use of a “deluge system” during rocket launches posed a threat to the environment. The system is underneath the Starbase launch tower, designed to prevent explosions during takeoff, applies a massive quantity of water to the rocket engine exhaust to absorb heat as it lifts off. While SpaceX has maintained that the system uses “clean, potable (drinking) water,” Save RGV contended that the wastewater produced by the system violated the Clean Water Act.
In an October lawsuit, Save RGV sought a restraining order to stop SpaceX from using the deluge system, effectively halting all rocket launches at the facility. The group claimed that wastewater released from the launches at Starbase, located roughly 25 miles east of Brownsville, Texas, could harm local ecosystems.
SpaceX responded to the suit, asserting that the Texas Commission on Environmental Quality (TCEQ) had already conducted a thorough review and found no environmental risks associated with the water-cooled flame deflector system. In a statement on 𝕏 (social media), SpaceX called the lawsuit “unwarranted and frivolous” and noted that Save RGV was aware of the environmental review prior to filing the lawsuit.

In his ruling, U.S. District Judge Rolando Olvera sided with SpaceX, denying the environmental group’s request for a restraining order. Olvera noted that halting the launches could have far-reaching consequences, including significant delays to NASA’s Artemis Program and the Starship Human Landing System Program, both of which rely on SpaceX for critical missions to the Moon. The contracts with NASA, valued at billions of dollars, could be at risk if the launches were stopped.
The judge also concluded that SpaceX’s operations were not harming the environment, citing the environmental reviews that had already been conducted. Olvera emphasized that the deluge water system was essential for protecting both the launch site and surrounding wildlife areas. He also pointed out that the system helps reduce fire hazards and dispersal of dust and debris. Notably, the water deluge system also reduces noise levels as the Super Heavy rocket lifts off with over 16 million pounds of thrust. As the water gushes out it absorbs and deflects the intense sound waves generated during liftoff, acting as a sound suppression system.
